POSH Internal Committee Checker, Complaint Timeline and Annual Report Format

What is the composition of the POSH Internal Committee?

Under section 4 of the POSH Act 2013 the Internal Committee has a Presiding Officer who is a woman employed at a senior level, at least two employees committed to the cause of women or with legal or social work experience, and one external member from an NGO or familiar with sexual harassment issues. At least half the members must be women, and members serve up to 3 years. Workplaces with fewer than 10 workers use the district's Local Committee instead.

The POSH Act gives the Internal Committee a fixed shape, and courts set aside inquiries by committees that got it wrong: no external member, no senior woman presiding, or members whose three-year term had run out.

Enter the committee as it stands; the checker tests each rule, lists the employer duties still open, works out the deadlines for a complaint, and drafts the annual report the committee owes each calendar year.

Annual report for a calendar year

    The deadlines after a complaint

A complaint must be made within 3 months of the incident, or of the last incident in a series; the committee can extend this by up to 3 months if it records its reasons (s.9). The inquiry must be completed within 90 days (s.11(4)), and the report goes to the employer within 10 days of completing it (s.13(1)). The employer must act on the recommendations within 60 days (s.13(4)), and anyone aggrieved can appeal within 90 days (s.18). During the inquiry, on the woman's written request, the committee can recommend her or the respondent's transfer, or up to 3 months' extra leave (s.12).

    The annual report

Section 21 requires the Internal Committee to prepare a report each calendar year and send it to the employer and the District Officer. Rule 14 lists what it contains: complaints received, complaints disposed of, cases pending for more than 90 days, workshops or awareness programmes held, and the action taken. File it even when there were no complaints. The Act sets no national filing date; many districts expect it in January, and some set their own date (Gurugram has asked for it by 28 February). Since 14 July 2025, companies must also give the complaints figures in the Board's report under the Companies (Accounts) Rules.

    Before you rely on this

What this will not tell you

This checks the Act's main rules; it does not replace the 2013 Rules, your service rules or legal advice. The Rule 7 "7 working days" step skips weekends but not public holidays. The Act sets no national filing date, and SHe-Box registration is not a duty in the Act or Rules, though the Supreme Court and some States have pressed for it; check with your District Officer. Questions

    Questions people actually ask

Is a POSH committee mandatory for small companies?

Every employer with 10 or more workers at an office or administrative unit must constitute an Internal Committee. Below 10, complaints go to the Local Committee for the district.

How many members must a POSH committee have?

At least four: a Presiding Officer, at least two employee members and one external member. At least half must be women.

What is the tenure of Internal Committee members?

Set by the employer, but not more than three years from the date of nomination.

What is the time limit for filing a POSH complaint?

Three months from the incident, or the last incident in a series. The committee can extend it by up to three more months if it records reasons in writing.

When is the POSH annual report due?

The Act requires one each calendar year but sets no national date. Most organisations file in January for the previous year; follow your District Officer's instructions.

What is the penalty for not forming an Internal Committee?

A fine of up to Rs 50,000. A repeat offence can bring double the penalty and cancellation or non-renewal of the business licence or registration.
